Terms of Service

By accessing or using PolyDefender (“the Service”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, do not use the Service.

These Terms apply to all users of the Service, including but not limited to developers, security professionals, and organizations using PolyDefender to scan applications.

PolyDefender is a security scanning platform that analyzes web applications, source code repositories, and related assets for security vulnerabilities, misconfigurations, and insecure coding patterns.

The Service provides automated security findings, vulnerability reports, and remediation guidance. PolyDefender is intended for use on applications and systems that you own or have explicit written authorization to test.

You may only scan systems you own or have explicit written authorization to test. Unauthorized scanning of systems you do not own is illegal in most jurisdictions and strictly prohibited by these Terms.

By using PolyDefender, you represent and warrant that:

• You are the owner of the target system, or
• You have received explicit written authorization from the owner to conduct security testing
• Your use complies with all applicable local, national, and international laws and regulations
• You will not use the Service for any illegal or unauthorized purpose

PolyDefender reserves the right to immediately terminate access and report unauthorized use to relevant authorities.

To access certain features of the Service, you must create an account. You agree to provide accurate, current, and complete information during registration and to update such information as necessary.

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must immediately notify PolyDefender of any unauthorized use of your account.

PolyDefender offers both free and paid subscription tiers. Paid subscriptions are billed in advance on a monthly or annual basis. All fees are non-refundable except as required by law or as stated in our refund policy.

We reserve the right to change pricing with 30 days' notice. Continued use of the Service after a price change constitutes acceptance of the new pricing.

Unused scans roll over only when your selected plan includes rollover. Purchased scans never expire.

You agree not to use the Service to:

• Scan systems without authorization
• Conduct denial-of-service attacks or disruptive scanning
• Attempt to bypass or circumvent rate limiting or access controls
• Resell or redistribute scan results without written permission
• Use the Service to harm, harass, or collect information about third parties
• Violate any intellectual property rights
• Introduce malware or malicious code through the Service

PolyDefender processes scan targets, findings, and account data in accordance with our Privacy Policy. Scan results are stored for the duration specified in your plan (90 days for Pro/Team, custom for Enterprise).

We do not sell your scan data to third parties. Scan findings are only accessible to your account and any teammates you authorize.

PolyDefender and its original content, features, and functionality are owned by PolyDefender and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

Scan reports generated by the Service are licensed to you for your own use. You may not redistribute or resell reports without explicit written permission from PolyDefender.

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. VIBESCAN DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE.

VIBESCAN DOES NOT GUARANTEE THAT ALL VULNERABILITIES WILL BE DETECTED. SECURITY SCANNING IS NOT A SUBSTITUTE FOR A COMPREHENSIVE SECURITY PROGRAM OR MANUAL PENETRATION TESTING.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, VIBESCAN SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICE.

You agree to indemnify, defend, and hold harmless PolyDefender and its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses (including legal fees) arising from your use of the Service, your violation of these Terms, or your violation of any rights of a third party.

PolyDefender reserves the right to modify these Terms at any time. We will notify users of significant changes via email or through the Service. Continued use after modifications constitutes acceptance of the updated Terms.

These Terms shall be governed by and construed in accordance with applicable law. Any disputes shall be resolved through binding arbitration, except where prohibited by law.
